Although this article is unnecessarily alarmist, The information in it is useful to both health app developers and app users. Recent guidance from the federal department of health and human services has clarified why most fitness apps do not trigger HIPAA rules. Of course, the Trump administration tends to side with business over consumer and privacy rights most of the time. Although, I actually support less regulation and more leniency in this area, health and fitness app developers should be aware that the more lenient approach advocated by the Trump administration could (and probably will) be easily reversed by a subsequent Democratic administration. So, it is probably wise to be careful how far one pushes the envelope in this area.
